On Deepening the Reform of Chief Prosecutor System in China

Chief Prosecutable System is a reform to make up for the various flaws and deficiencies in prosecutable activities and prosecutable system. The reform of Chief Indictable System has made some achievements, but problems still exist. In order to enhance the judicial independence of prosecutable activities and to reduce administrative intervention, the paper suggests the following measures: 1) separate the prosecution operational activities and prosecution managing activities; 2) adjust the relationships between Chief Prosecutor and the head of the section as well as the Prosecutor-General; 3) give Chief Prosecutor greater independent official power. The reform should strengthen the objective obligations of Chief Prosecutor and properties of judicial review, and construct Prosecutable Court System in People's Procuratorates to realize correspondence and coordination with People's Courts on the form of working organization.
